In the following, the terms below shall have the following meaning:
"CASA PEDRO ": CASA PEDRO Limited Liability Company with a capital of

100,000 Euros, registered with the PARIS Trade and Companies Register under no. B 804183952 and whose registered office is located in Paris (75007) 60, Rue de VARENNE,

represented by its Manager Mr. Pierre SAUVAGE - Intracommunity VAT number.

CASA PEDRO markets products of the CASA LOPEZ brand, of which it is the owner.

 

CASA LOPEZ: brand registered with the National Institute of Industrial Property (I.N.P.I) under number 3204099, owned by CASA PEDRO. 

 Order Registration ”: Dematerialized document sent by CASA PEDRO to the Customer at the end of the order process and its validation by the Customer, carried out via the Internet on the website defined below, as stated in Article 4.3.3, summarizing the purchase of products as validated by the Customer and confirming the registration by the website of the order placed by the Customer online on the said website, reproducible on a durable medium by the Customer, which summarizes the characteristics of the products purchased by the Customer, the delivery terms and deadlines, the terms of exercising the right of withdrawal, the form for which is attached to the said dematerialized document. 

 Sales Contract ”: Online contract concluded by CASA PEDRO and the Customer, following the validation of their order for one or more products offered on the website defined below and the receipt by them of the registration of their order. 

 Customer ”: Adult natural person with full legal capacity when entering into the sales contract or legal entity duly represented by a natural person having the quality and legal capacity to represent it.

"Email ": Any message, in the form of text, voice, sound or image, sent over a public communication network, stored on a network server or in the recipient's terminal equipment, until it is retrieved by the latter. 

 Order ”: process implemented online by the Customer from the website defined below, consisting of choosing, selecting products and their quantities for the cart, which ends with the validation of the order and subject to payment of the corresponding price. 

 Mobile Services ”: All services and protocols allowing mobile phones to connect to the Internet, including placing orders. 

 Products ”: Various products marketed by CASA PEDRO, on the website, particularly under the headings "Tapis Rubans Croisés", "Tapis Palais d’Eté", "Tapis Semeuses", "Tapis Polichinelle". This list is not exhaustive. The essential characteristics of these products, in accordance with the provisions of Article L. 111-1 of the Consumer Code, are displayed as soon as the Customer clicks on the chosen product from the website.

ARTICLE 1 – SCOPE OF APPLICATION

1.1 Extent

1.1.1 These General Terms and Conditions of Sale apply, without restriction or reservation, to all products offered on the website by the company CASA PEDRO operating the aforementioned website for the purpose of marketing the Products.

1.1.2. These General Terms and Conditions apply to all order and sales operations defined above carried out by the Customer.

1.2 Territory

The products featured on this website are offered for supply to the Customer by CASA PEDRO, involving delivery to all territories covered by the carriers concerned by the Delivery.

1.3 Duration

1.3.1. These General Terms and Conditions apply for the entire duration of the online marketing of the Products on the website by CASA PEDRO.

1.3.2. CASA PEDRO reserves the right, without prior notice or compensation, to temporarily or permanently close the website or the online sales area for the Products.

1.3.3. CASA PEDRO is not responsible for damages of any kind that may result from a temporary unavailability or the definitive closure of all or part of the site or the marketing services of the Products associated therewith, such as the ability to place an order. 

1.3.4. CASA PEDRO reserves the right to adapt or modify these General Terms and Conditions of Sale at any time. In the event of modification, the General Terms and Conditions of Sale in force at the time of order validation will apply to each order.

1.4 Legal Framework

1.4.1. These General Terms and Conditions of Sale are subject to the provisions of articles L. 121-16 et seq. of the Consumer Code.

1.4.2. Any order, for the purchase of the Products defined above, placed on the website is subject to these General Terms and Conditions.

1.5. Purpose

1.5.1. These General Terms and Conditions define the rights and obligations of the parties in the context of the sale of Products offered by CASA PEDRO on the website

1.5.2. They govern all the necessary steps for the realization and follow-up of the order, its maintenance and validity, the purchasing process of the Product(s) chosen by the Client, the payment of the corresponding price, and the delivery conditions of the Product(s) sold to the Client by CASA PEDRO. 

ARTICLE 2 – CUSTOMER CAPACITY AND ACCEPTANCE

2.1. Every Customer acknowledges having the capacity to contract under the conditions described in the General Terms and Conditions presented hereafter, i.e., being of legal age and not being under guardianship or curatorship.

2.2. The Customer acknowledges that these Terms and Conditions are presented to him/her prior to the validation of his/her order. 

2.3. The Customer accepts that the General Terms and Conditions of Sale, the contractual documents informing him/her of the essential characteristics of each of the Products and associated prices, as well as the order forms and order procedures, be presented online on the website for the purpose of concluding the Sales Contract relating to the Products ordered by him/her.

2.4. The Customer declares having obtained all necessary information from CASA PEDRO on the website.

2.5. The Customer acknowledges having read these General Terms and Conditions of Sale prior to their acceptance and having accepted all their terms prior to the validation of his/her order. 

2.6. Any online order validation from the website by the Customer requires prior acceptance of these General Terms and Conditions of Sale.

2.7. The Customer's agreement concerning these General Terms and Conditions of Sale occurs during the ordering process, prior to the validation of their purchase by mandatory validation of the box reserved for this purpose indicating "I have read and accept the General Terms and Conditions of Sale and I adhere to them without reservation (read the General Terms and Conditions of Sale ". 

2.8. The Customer, prior to ordering the Products, declares and acknowledges having created an account where they have carefully entered their email address and password so that they can be identified later.

They will complete their account by entering their personal information: their surname, first name, and date of birth.

Finally, they can complete the information relating to the desired delivery address, with the possibility of entering a second billing address.

2.9. The Customer expressly accepts that the entry of the required banking information, the acceptance of these General Terms and Conditions, and the validation of the order take place online on the website.

ARTICLE 3 – WEBSITE CONTENT

3.1. The site mentions the following information:

The precise identification of the Company CASA PEDRO, indicating its corporate name, the address where it is established, its email address, its telephone number, its registered office, if it is subject to value-added tax its individual identification number, and, if different, the address of the Establishment responsible for the offer;

• the essential characteristics of the Products are displayed as soon as the Customer clicks on the chosen product, with, where applicable, one or more options to select (for example, size, color, containers) and, in all cases, a choice concerning the quantity of products to order;

• the actual availability of Products in stock at the time of order, either according to the default product format proposal, or following the prior validation of options other than those displayed by default when the Customer consults the page.

• the prices of each of the Products;

• payment methods;

• the General Terms and Conditions of Sale;

• the actual availability of the offer at the time of order;

• the existence of a right of withdrawal, its exercise procedures and the duration of exercise of this right,

• where applicable, the order cancellation procedures;

3.2. All information on the website is presented in French.

ARTICLE 4 - ORDER

4.1. Online Order Procedures

4.1.1. The Customer chooses the Products presented on the website, which offers him the possibility to reserve one or more diverse Products of his choice, according to contractual prices displayed on each product page with or without options left to the Customer's free choice.

4.1.2. The Customer acknowledges having read the terms of ordering the Products available on the website and having requested and obtained the necessary and/or additional information to place his order with full knowledge of the facts.

4.1.3. The Customer is solely responsible for the choice of Products and their suitability for his needs, so that CASA PEDRO cannot be held liable in this regard for the Customer's choice and the content of his order.

4.1.4. The order is deemed accepted by the Customer at the end of the order process by clicking on the "ORDER" button in case of payment by credit card on the last page of the order process as described below.

4.2. Online Order Process

4.2.1. Orders placed by the Customer can be made via the dematerialized order form accessible online on the website.

4.2.2. The order is deemed to be formed upon registration of the order by CASA PEDRO as stated in article 4.3 and subject to online payment by credit card under the conditions referred to in article 4.2.5.

4.2.3. The Customer undertakes, prior to any order, to complete the requested information, and in particular, that relating to his mandatory personal data marked with an asterisk upstream of the fields for collecting this information.

4.2.4. The Customer certifies the truthfulness and accuracy of the information transmitted.

4.2.5. The order procedure, including the collection of personal data which is secured under the conditions of Article 9 below, notably includes the following steps, it being specified that from the beginning of the order process, the Customer is informed that payment by credit card is mandatory and that delivery is limited to the territorial zones served by the providers responsible for transporting the products,

4.2.5.1. Step 1 - SUMMARY

This step consists of choosing the Products: the Customer determines, by clicking in the sections "Tapis Rubans Croisés", "Tapis Palais d’Eté", "Tapis Semeuses", "Tapis Polichinelle", this list being non-exhaustive, access to the pages relating to the products offered for sale online;

This step is valid and can be declined regardless of the Product selected by the Customer by clicking on the chosen product: the Customer determines the number of products ordered, any applicable options (color, size, etc.).

4.2.5.2. Step 2 – IDENTIFY YOURSELF

This step requires the Customer to identify themselves as the author of the order, with the necessity, during their first order on the website, to create a personal account implying the obligation to complete the fields marked with an asterisk, and more particularly, their email address, their name, their first name, their password, their physical delivery address for the products and, depending on a choice option, their billing address if it differs from the delivery address.

4.2.5.3. Step 3 - ADDRESS

This step consists of displaying a summary of the Customer's identifier and postal details and, where applicable, a different billing address with the possibility for the Customer to modify them using the "update" button, to add an address, to separate the delivery address from the billing address and to leave a message about their order.

If the recipient of the order is not its author during the ordering process, the Customer can modify the recipient's identity.

To continue with the order, the Customer must click on the "ORDER" button.

4.2.5.4. Step 4 - DELIVERY

This step consists of the Customer choosing different delivery methods from those entered by default at the end of the order in the SUMMARY stage and as indicated in Article 6.3.4, according to the proposed and possible choices depending on the destinations, namely:

- DPD Predict / DPD Europe

- UPS or DHL

- Private carrier, more particularly for deliveries of carpets and oversized products.

The price of each of the proposed delivery services for the ordered products and their provider is indicated, with the Customer having the option to determine their choice of delivery methods in the event that several choices are available.

The delivery time for ordered products is indicated based on the destination provided for the delivery location and corresponds to the Customer's choice of transport method and carrier. The delivery time indicated during the booking process is that of the carrier chosen by the Customer for the chosen destination. The delivery time can only be counted from the moment the order is shipped and, in any case, upon successful receipt of payment by CASA PEDRO.

The Customer must necessarily accept these General Terms and Conditions of Sale as indicated in article 2.7, accessible on the site before being able to continue his order by clicking on the "ORDER" button which allows his order to be displayed with,

- the summary of the products as already displayed and known from Step 1,

- the delivery conditions of the chosen provider, as selected by the Customer during Step 4, these including any options offered for the Customer's choice.

4.2.5.5. Step 5 - PAYMENT

Upon validation of the delivery conditions, the Customer arrives at the page dedicated to online payment.

Payment is made exclusively online by credit card.

The Customer chooses the corresponding card, accepted according to the online payment protocol, namely: CB, VISA, Master Card, or PAYPAL by clicking on the corresponding icon. If necessary, depending on the protocols specific to the banking institution to which the payment method used is linked, the Customer may be required to complete additional security codes.

4.2.6. CUSTOMER ACCOUNT

At any time during the order process, or even without placing an order, the Customer can consult their Customer account, which they must have created during their first order as stated in article 4.2.5.2.

4.3. Online Contract Formation

4.3.1. The online sales contract is formed only after the Customer has, at the end of the order process and its 5 steps described in 4.2:

clicked on the "VALIDATE" button.

Otherwise, the order is considered interrupted and cannot produce any effect.

4.4 Right of Withdrawal by the Customer :

In accordance with Article L. 121-21 of the Consumer Code, the Customer has a right of withdrawal, without reason or penalties, with the exception of the postal re-shipping costs of the products concerned by the withdrawal, of 14 calendar days from the day of receipt of the products subject to their order.

4.5. Product Availability:

The products offered on the website constitute the offer of said products within the limits of available stock.

ARTICLE 5 – PRICES / COST / PAYMENT

5.1. Product prices are indicated before and during the order process as stated in Article 4.2.5. Prices are valid in real time and are displayed as soon as the Customer consults a product on the website. The price of ordered products is necessarily displayed under the "Quantity" display.

5.2. Product prices are subject to value added tax (VAT) and are displayed including all taxes at the rate in force at the time of order, in Euros, and are only valid at the time of order on the website.

5.3. All orders, regardless of their origin, are payable in Euros as specified during the order process, with any exchange fees from the Customer's banking institution remaining the responsibility of the latter.

5.4. Delivery charges are indicated during the order process as specified in articles 4.2.5 and 6.3.4. If several rates are available for delivery, they are displayed during step 4 of the order process as indicated in 4.2.5.4.

5.5. The price of the order, i.e. the price of the products and their delivery, is communicated on the website during the order process. The inclusive price of the order is indicated to the Customer before the confirmation of their order and before payment.

5.6. No discount or rebate will be applied by CASA PEDRO for online payment prior to the contemplated delivery dates and conditions set forth in these General Terms and Conditions of Sale.

5.7. CASA PEDRO reserves the right to modify prices at any time but products will be invoiced based on the rates in effect at the time of order placement.

5.8. In the event of an incorrect price being displayed during the order process, for whatever reason (computer bug, manual entry error, technical incident), the order (even if it has been registered under the conditions of article 4.3.3) will be cancelled as soon as CASA PEDRO discovers the incident. In this case, the Customer will be informed by sending an email to the address provided during the order process or account creation. After sending this information message, the Customer may, if they wish, re-place their order at the corrected and accurate price.

5.9. The order price is due upon completion of the order process as indicated in article 4.2.5.5.

5.10. Payment of the order price by the Customer occurs under the conditions set out in article 4.2.5.5.

ARTICLE 6 – DELIVERY

6.1. Delivery methods:

6.1.1. Delivery of ordered products occurs under the conditions chosen and validated by the Customer during the order process as stated in article 4.2.5.4.

6.1.2. Depending on the destinations, delivery is offered during the order process through the services of the following providers:

- DPD Predict / DPD Europe

- UPS

- Private carrier, particularly for deliveries of rugs and oversized products.

6.2. Delivery costs:

6.2.1. Delivery costs are borne by the Customer and are invoiced in addition to the selling price of the products.

6.2.2. Delivery costs are communicated to the Customer on the order summary, and in any case before the validation of their order by the Customer at the end of the order process, and are expressed inclusive of all taxes.

6.2.3. Customs duties and other charges in the country of arrival are the responsibility of the recipient.

6.3. Delivery times:

6.3.1. The delivery times indicated below are those generally observed for the shipping services that may be offered during the order process, depending on the different providers:

- DPD Predict: 6 to 7 days maximum.

- UPS, DPD Europe and other private carriers: 15 days maximum.

6.3.2. Delivery times are calculated from the shipping date of the order (provided that payment of the order price has been duly received), only concern working days, and do not include Saturdays, Sundays, and public holidays.

6.3.3. For information purposes, it is specified that parcels are generally dispatched within 48 hours after CASA PEDRO has received and successfully collected the Customer's payment.

 

6.3.4. By default and before the Customer reaches the process of determining their choice regarding delivery methods and times as described in article 4.2.5.4., the order summary as described in article 4.2.5.1 proposes a standard transport rate offered by the DPD Provider. The Customer can always modify their choice and the delivery and transport methods that suit them under the conditions of article 4.2.5.4 before validating their order.

6.3.5. The parcel related to the order is dispatched to the Customer, subject to the responsibility of the transport and delivery provider; particular care is taken with parcels containing fragile products.

6.3.6. CASA PEDRO cannot be held responsible for consequences due to a delay in delivery by the Carrier resulting from an unforeseeable and irresistible event.

6.3.7. Each parcel shipment is accompanied by the invoice corresponding to the Customer's order.

6.4. Receipt of delivery:

6.4.1. The Customer is obliged to check the conformity of the Products received in execution of their order at the time of delivery. Any anomaly concerning the delivery such as:

- damaged package,

- missing products,

- damaged products,

- products not conforming to the order,

must be notified within 48 hours of receipt of the order to the website's Customer Service via the email address serviceclient@casalopez.com. After this 48-hour period, in the absence of confirmation by registered letter with acknowledgment of receipt and except for hidden defects, no claim will be accepted by CASA PEDRO, and the Products sent by CASA PEDRO to the Customer will then be considered compliant.

6.4.2. In any case, damaged or incomplete items will not be taken back by CASA PEDRO and will be returned to the Customer as is, should they be re-sent to CASA PEDRO by the Customer, at the Customer's expense.

6.4.3. Parcels returned to CASA PEDRO or to the carrier chosen by the Customer during their order process, due to a failure to identify the recipient or a failure to identify the order concerned, may be resent to the Customer, provided that:

- the Customer contacts CASA PEDRO,

- the parcel proves identifiable,

- the parcel is effectively returned to CASA PEDRO or is still in the hands of the said carrier,

- the Customer bears the cost of this second shipment of the parcel.

6.4.4. Subject to the conditions recalled above, CASA PEDRO will refund the inclusive price (of the) Product(s) excluding delivery charges provided for in the order and excluding reshipment costs of the products by the Customer. The Customer's bank account, as provided by them during the order process as stated in article 4.2.5.5., will be credited with the said amount within thirty (30) days from the receipt of the Products by CASA PEDRO.

6.4.5. Return costs for a product declared non-compliant with the order will be covered by CASA PEDRO, provided that the Customer makes an express request to this effect under the conditions of article 6.4.1 for a shipping label to be sent to them at CASA PEDRO's expense.

ARTICLE 7 – COMPLAINTS

ARTICLE 8 – GUARANTEES AND RESPONSIBILITIES OF CASA PEDRO

8.1. In all cases, CASA PEDRO cannot be held responsible for the failure of an order to complete and its non-registration, particularly due to the Customer failing to correctly fill out their order according to the conditions set out in these General Terms and Conditions of Sale and according to what is displayed on the Customer's fixed or mobile computer terminal during the online order process.

8.2. In all cases, CASA PEDRO cannot be held responsible for the non-delivery of a registered order due to the Customer failing to correctly provide information relating to the delivery address or the identification of the recipient, in accordance with the conditions set out in these General Terms and Conditions of Sale and as displayed on the Customer's fixed or mobile computer terminal during the online ordering process.

8.3. In all cases of force majeure and, in particular, due to an unforeseeable and irresistible act of the carrier, CASA PEDRO cannot be held responsible for the non-delivery of a registered order. More generally, CASA PEDRO cannot be held responsible for the non-execution or poor execution of the order in cases of force majeure, third-party action, Customer action, or action by its partners such as internet network unavailability, inability to access the website, external intrusion, computer viruses, or, in the case of online payment, refusal by the bank of the credit card holder used for payment to authorize the transaction.

8.4. CASA PEDRO strives to ensure that the photographs and descriptions of the products provide as accurate a representation as possible of the products offered for online sale on the website. However, the photographs are non-contractual, so the Customer cannot claim any complaint on this basis, provided that these differences between the photograph on the sales site representing the product and the product itself do not relate to essential characteristics of the product that would furthermore be falsely or inaccurately represented on the website.

8.5. CASA PEDRO shall not incur any liability for any indirect and/or intangible damages, including, but not limited to, loss of profit, loss of business, moral damage resulting from a total or partial failure of delivery or a total or partial non-conformity of the ordered products.

8.6. Hyperlinks present on the website may refer to sites other than the website www.casalopez.com used for ordering products online from CASA PEDRO, whether these are sites dedicated to services offered by CASA PEDRO or by third-party companies or partners.

8.7. The provisions of Article 8 do not prejudice the application of the provisions of Article 4.2.2.

8.8. In any event, CASA PEDRO cannot be considered as the Producer of the products offered for sale on the website within the meaning of articles 1386-1 et seq. of the French Civil Code, the latter being solely and exclusively responsible for damage caused by a defect in its product, whether or not it is bound by a contract with the victim. In the event that a delivered product ordered proves to be defective, it is the Customer's responsibility to notify CASA PEDRO of this fact at the contact details provided in the preliminary article by registered mail with acknowledgment of receipt, in order to allow CASA PEDRO to designate its own supplier or the producer, within three months from the date on which the victim's request was notified to it.

ARTICLE 9 – IT, FREEDOM AND PRIVACY, PERSONAL DATA, RIGHT TO IMAGE

9.1. The Customer is informed that all personal data collected during the order process, and particularly concerning the creation of their customer account as stated in article 4.2.5.2, will be subject to automated processing for which CASA PEDRO is the data controller, whose full contact details appear in the preliminary article of these General Terms and Conditions of Sale.

9.2. The information containing personal data requested from the Customer during the order process on the website is intended to be communicated by the Customer and is necessary for CASA PEDRO to process their order.

9.3. The recipients of the personal data collected during the order process are:

- CASA PEDRO;

- The online payment provider to the extent necessary for the implementation of articles 4.2.5.5, 5.10 of these General Terms and Conditions of Sale.

9.4. The purpose of processing this personal data is to allow CASA PEDRO to:

• process the order;

• register the order;

• fulfill its obligations to the Customer;

• integrate the Customer into the "Customer File."

9.5. In accordance with the provisions of Law n°78-17 of January 6, 1978, relating to data processing, files, and freedoms, each Customer has a right to access, modify, and rectify information concerning them, under the conditions provided by law and current regulations, by contacting CASA PEDRO at the coordinates indicated in the preliminary article of these General Terms and Conditions of Sale. The Customer also has, for legitimate reasons, a right to object to the processing of data concerning them.

9.6. The Customer is informed, on each personal data collection form, and more particularly for those displayed during the order process or creation of their customer account, of the mandatory or optional nature of the fields to be completed, respectively, by the presence or absence of an asterisk. In the event of failure to provide one or more data indicated as mandatory during the online order process, the Customer's order cannot be completed or taken into account in any way whatsoever.

9.7. Particularly when making an online payment involving the communication of the Customer's bank details for payment purposes as stated in Article 4.2.5.5, these bank details will not be in the possession of CASA PEDRO, but must nevertheless be communicated for the execution of the sales contract by the Customer given their obligation to pay the price. The Customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection within the meaning of Law n°78-17 of January 6, 1978 (art. 69-6°). In any event, the Customer consents to this transfer for the execution of the sales contract resulting from the registration of their order with CASA PEDRO.

9.8. The Website does not generate cookies dedicated to the order placed by the Customer for products offered for sale on the website. However, the browser used by the Customer for the purpose of accessing and completing the online ordering process is likely to generate cookies that will, in particular:

• facilitate the recognition of the Customer from the terminal from which the order is placed, if applicable,

• allow tracking of the progress of their ordering process, in particular to allow them to go back during this process,

• allow the collection of statistical and technical data on the progress of the ordering process followed by the Customer that may be communicated to CASA PEDRO, identified at the beginning of this document, without any personal data of the Customer being attached, for the purposes of modifying and improving the technical and ergonomic aspects of the online ordering process and the corresponding interface.

In all cases, it is up to the Customer using a terminal from which they place their online order to determine the extent to which they wish to disable or allow cookies generated by their browser used during the online ordering process, without CASA PEDRO being held liable in this respect.

ARTICLE 10 – MISCELLANEOUS

10.1. These General Terms and Conditions of Sale are governed by French law.

10.2. In the event that any provision of these General Terms and Conditions of Sale is declared null or void, in any way and for any reason whatsoever, it shall be deemed unwritten and shall not invalidate the other provisions.

10.3. All disputes that may arise between the parties in connection with the interpretation and/or execution of these General Terms and Conditions of Sale shall be submitted, failing amicable agreement, to the exclusive jurisdiction of the competent court within the jurisdiction of the Paris Court of Appeal, with the exception of disputes concerning non-commercial persons for which the legal rules of material jurisdiction apply.
