Terms of Use
In the remainder of this document, the terms below shall have the following meanings:
"CASA PEDRO" " : The Limited Liability Company CASA PEDRO with a capital of
100,000 Euros, registered with the Paris Trade and Companies Register under number B 804183952 and whose registered office is located in Paris (75007) 60, Rue de Varenne,
represented by its Manager Mr Pierre SAUVAGE - Intra-community VAT number.
The company CASA PEDRO markets products of the brand CASA LOPEZ, which it owns.
CASA LOPEZ : trademark registered with the National Institute of Industrial Property (INPI) under number 3204099, property of the company CASA PEDRO.
" Order registration " : Electronic document sent by CASA PEDRO to the Customer at the end of the order process and its validation by the Customer, carried out via the internet on the website defined below, as stated in article 4.3.3, summarizing the purchase of products as validated by the Customer and confirming the registration by the website of the order made by the Customer online on said website, reproducible on a durable medium by the Customer which summarizes the characteristics of the products purchased by the Customer, the terms and delivery times, the terms of exercising the right of withdrawal, the form of which is attached to said electronic document.
" Sales contract " : Online contract concluded between the Company CASA PEDRO and the Client, following the validation of his order for one or more products offered on the website defined below and the receipt by him of the registration of his order.
" Customer " : Natural person of legal age having full legal capacity at the time of signing the sales contract or legal entity duly represented by a natural person having the quality and legal capacity to represent it.
"Email" " : Any message, in the form of text, voice, sound or image, sent via a public communication network, stored on a network server or in the recipient's terminal equipment, until the recipient retrieves it.
" Order " : process implemented online by the Customer from the website defined below, consisting of choosing, selecting the products and their quantities for the shopping cart which is completed upon validation of the order and subject to payment of the corresponding price.
" Mobile services " : The set of services and protocols that allow mobile phones to connect to the Internet, including placing orders.
" Products ": Various products marketed by CASA PEDRO on its website, notably under the headings "Crossed Ribbon Rugs", "Summer Palace Rugs", "Sower Rugs", and "Punch and Judy Rugs". This list is not exhaustive. The essential characteristics of these products, in accordance with the provisions of Article L. 111-1 of the French Consumer Code, are displayed as soon as the Customer clicks on the chosen product from the website.
"Website": electronic service operated by CASA PEDRO on the internet and accessible at the URL www.casalopez.com
ARTICLE 1 – SCOPE OF APPLICATION
1.1 Scope
1.1.1 These General Terms and Conditions of Sale apply, without restriction or reservation, to all products offered on the website by the company CASA PEDRO, which operates the aforementioned website for the purpose of marketing the Products.
1.1.2. These General Terms and Conditions apply to all order and sales transactions defined above carried out by the Customer.
1.2 Territory
The products listed on this website are offered to be supplied to the Customer by CASA PEDRO, implying delivery to all territories covered by the carriers involved in the Delivery.
1.3 Duration
1.3.1. These General Terms and Conditions apply for the entire duration of the online marketing of the Products on the website by CASA PEDRO.
1.3.2. CASA PEDRO reserves the right, without notice or compensation, to temporarily or permanently close the website or online sales area for the Products.
1.3.3. CASA PEDRO is not responsible for damages of any kind which may result from a temporary unavailability or even the permanent closure of all or part of the site or the marketing services of the Products associated with it, such as the possibility of placing an order.
1.3.4. CASA PEDRO reserves the right to adapt or modify these General Terms and Conditions of Sale at any time. In the event of modification, the General Terms and Conditions of Sale in effect at the time the order is validated will apply to each order.
1.4 Legal framework
1.4.1. These General Terms and Conditions of Sale are subject to the provisions of Articles L. 121-16 et seq. of the Consumer Code.
1.4.2. Any order for the purchase of the Products defined above, placed on the website, is subject to these General Terms and Conditions.
1.5. Purpose
1.5.1. These General Terms and Conditions define the rights and obligations of the parties in connection with the sale of Products offered by CASA PEDRO on the website
1.5.2. They govern all the steps necessary for the execution and monitoring of the order, its maintenance and validity, the purchase process of the Product(s) concerned chosen by the Customer, the payment of the related price, and the delivery conditions of the Product(s) sold to the Customer by CASA PEDRO.
ARTICLE 2 – CUSTOMER CAPACITY AND ACCEPTANCE
2.1. Every Client acknowledges having the capacity to contract under the conditions described in the General Terms and Conditions presented below, i.e. having the legal majority and not being under guardianship or curatorship.
2.2. The Customer acknowledges that these Conditions are presented to him prior to the validation of his order.
2.3. The Customer accepts that the General Terms and Conditions of Sale, the contractual documents informing him of the essential characteristics of each of the Products and related prices, as well as the order forms and ordering procedures, are presented to him online on the website for the purpose of concluding the Sales Contract relating to the Products ordered by him.
2.4. The Client declares that they have obtained from CASA PEDRO all the necessary information on the website.
2.5. The Customer acknowledges having read these General Terms and Conditions of Sale prior to their acceptance and having accepted all of the terms prior to validating his order.
2.6. Any online order validation via the website by the Customer requires prior acceptance of these General Terms and Conditions of Sale.
2.7. The Customer's agreement to these General Terms and Conditions of Sale occurs during the ordering process, prior to the validation of their purchase by checking the box provided for this purpose indicating " I have read and agree to the General Terms and Conditions of Sale and I adhere to them without reservation" (read the General Terms and Conditions of Sale). "
2.8. Prior to ordering the Products, the Customer declares and acknowledges having created an account where he has taken care to enter his email address and password so that he can be identified later.
He will complete his account by providing his personal information: his name, surname and date of birth.
Finally, he will be able to complete the information relating to the desired delivery address, with the possibility of providing a second billing address.
2.9. The Customer expressly agrees that the entry of the required bank details, the acceptance of these General Terms and Conditions and the validation of the order, take place online on the website.
ARTICLE 3 – WEBSITE CONTENT
3.1. The site mentions the following information:
The precise identification of the Company CASA PEDRO, indicating its company name, the address where it is established, its email address, its telephone number, its registered office, if it is subject to value added tax its individual identification number, and, if different, the address of the Establishment responsible for the offer;
• the essential characteristics of the Products are displayed as soon as the Customer clicks on the chosen product, with, where applicable, one or more options to select (for example, size, color, containers) and, in all cases, a choice regarding the quantity of products to order;
• the actual availability of Products in stock at the time of ordering, either according to the proposal of the default product format, or according to the prior validation of other options than those displayed by default when the Customer consults the page.
• the prices of each of the Products;
• the payment terms;
• the General Terms and Conditions of Sale;
• the actual availability of the offer at the time of ordering;
• the existence of a right of withdrawal, the procedures for exercising this right and the duration of its exercise,
• where applicable, the order cancellation procedures;
3.2. All information on the website is presented in French.
ARTICLE 4 - ORDER
4.1. Online Ordering Procedures
4.1.1. The Customer chooses the Products presented on the website, which offers him the possibility of reserving one or more different Products of his choice, according to contractual prices displayed on the page of each product with or without options left to the Customer's free choice.
4.1.2. The Customer acknowledges having read the ordering procedures for the Products available on the website and having requested and obtained the necessary and/or additional information to make his order with full knowledge of the facts.
4.1.3. The Customer is solely responsible for the choice of Products and their suitability to his needs, such that CASA PEDRO cannot be held liable in this regard for the Customer's choice and the content of his order.
4.1.4. The order is deemed accepted by the Customer at the end of the ordering process by clicking on the "ORDER" button in the case of payment by bank card on the last page of the ordering process as described below.
4.2. Online Ordering Process
4.2.1. Orders placed by the Customer can be made via the electronic order form accessible online on the website.
4.2.2. The order is deemed to have been formed upon registration of the order by CASA PEDRO as stated in article 4.3 and subject to online payment by bank card under the conditions referred to in article 4.2.5.
4.2.3. The Customer undertakes, prior to any order, to complete the information requested and, in particular, those relating to his mandatory personal data marked with an asterisk upstream of the fields for collecting this information.
4.2.4. The Client attests to the truthfulness and accuracy of the information transmitted.
4.2.5. The ordering procedure, the collection of personal data for which is secured under the conditions of Article 9 below, includes, in particular, the following steps, it being specified that from the beginning of the ordering process the Customer is informed that payment by bank card is mandatory and that delivery is limited to the territorial areas served by the service providers responsible for transporting the products,
4.2.5.1. Step 1 - SUMMARY
This step consists of choosing the Products: the Customer determines, by clicking in the sections "Crossed Ribbon Rugs", "Summer Palace Rugs", "Sower Rugs", "Polichinelle Rugs" this list being non-exhaustive, access to the pages relating to the products offered for sale online;
This step is valid and can be applied regardless of the Product selected by the Customer by clicking on the chosen product: the Customer determines the number of products ordered, any applicable options (colour, size, etc.).
4.2.5.2. Step 2 – IDENTIFY YOURSELF
This step involves the Customer identifying themselves as the author of the order, which requires, when placing their first order on the website, the creation of a personal account involving the obligation to complete the fields marked with an asterisk and, more specifically, their email address, their name, their first name, their password, their physical delivery address for the products and, depending on a choice option, their billing address if it is different from the delivery address.
4.2.5.3. Step 3 - ADDRESS
This step involves displaying a summary of the Customer's ID and postal address and, where applicable, different billing address, with the possibility for the Customer to modify them under the "update" button, to add an address, to separate the delivery address from the billing address and to leave a message about their order.
If the recipient of the order is not the author of it during the ordering process, the Customer can change the identity of the recipient.
To proceed with their order, the Customer must click on the "ORDER" button.
4.2.5.4. Step 4 - DELIVERY
This step involves the Customer choosing delivery methods different from those entered by default at the end of the order in the SUMMARY step and as indicated in article 6.3.4, according to the choices offered and possible depending on the destinations, namely:
- DPD Predict / DPD Europe
- UPS or DHL
- Private carrier, more specifically for deliveries of carpets and oversized products.
The price of each of the delivery services for the ordered products offered and their provider is indicated with the possibility for the Customer to determine the choice of their delivery methods in the event that several choices are available.
The delivery time for ordered products is determined by the specified delivery address and corresponds to the shipping method and carrier chosen by the customer. The delivery time indicated during the booking process is that of the carrier selected by the customer for the chosen destination. The delivery time can only be calculated from the moment the order is shipped and, in any case, upon successful receipt of payment by CASA PEDRO.
The Customer must necessarily accept these General Terms and Conditions of Sale as indicated in article 2.7, accessible on the website, before being able to proceed with their order by clicking on the "ORDER" button, which displays their order with,
- the product summary as already displayed and known since Step 1,
- the delivery conditions of the chosen service provider, as chosen by the Client during Step 4, the latter including possible variations offered at the Client's choice.
4.2.5.5. Step 5 - PAYMENT
After validating the delivery conditions, the Customer arrives at the page dedicated to online payment.
Payment is made exclusively online by credit card.
The Customer selects the corresponding card, accepted according to the online payment protocol, namely: CB, VISA, MasterCard, or PAYPAL, by clicking on the corresponding icon. If applicable, depending on the protocols specific to the banking institution to which the payment method is linked, the Customer may be required to enter additional security codes.
4.2.6. CUSTOMER ACCOUNT
At any time during the ordering process, or even without placing an order, the Customer can consult his Customer account which he necessarily created during his first order as stated in article 4.2.5.2.
4.3. Online Contract Formation
4.3.1. The online sales contract is formed only after the Customer has, at the end of the ordering process and its 5 steps described in 4.2:
clicked on the "VALIDATE" button.
Otherwise, the order is considered interrupted and cannot produce any effect.
4.4 Right of Withdrawal by the Customer :
In accordance with Article L. 121-21 of the Consumer Code, the Customer has the right of withdrawal, without reason or penalty except for the postage costs of returning the products concerned by the withdrawal, for 14 calendar days from the day of receipt of the products which are the subject of his order.
4.5. Product availability:
The products offered on the website constitute the offer of said products within the limits of available stocks.
ARTICLE 5 – RATES / PRICES / PAYMENT
5.1. Product prices are displayed before and during the ordering process as indicated in section 4.2.5. Prices are valid in real time and are displayed as soon as the Customer views a product on the website. The price of the ordered products is always shown under the "Quantity" label.
5.2. Product prices are subject to value added tax (VAT) and are displayed in Euros, inclusive of VAT at the rate in force at the time of the order, and are valid only at the time of the order on the website.
5.3. All orders, regardless of their origin, are payable in Euros as specified during the ordering process, with any exchange fees with the Client's bank remaining the responsibility of the latter.
5.4. Delivery charges are indicated during the order process as specified in articles 4.2.5 and 6.3.4. If several rates are available for delivery, they are displayed during the order process in step 4 as indicated in 4.2.5.4.
5.5. The order price, including the price of the products and their delivery, is displayed on the website during the ordering process. The total price including VAT is shown to the Customer before order confirmation and before payment.
5.6. No discount or rebate will be granted by CASA PEDRO for online payment prior to the planned delivery dates and conditions set out in these General Terms and Conditions of Sale.
5.7. CASA PEDRO reserves the right to change prices at any time, but products will be invoiced based on the rates in effect at the time the orders are placed.
5.8. If an incorrect price is displayed during the ordering process, for whatever reason (computer bug, manual data entry error, technical issue), the order (even one registered under the conditions of Article 4.3.3) will be cancelled as soon as CASA PEDRO discovers the error. In this case, the Customer will be notified by email to the address they provided during the ordering process or when creating their Customer account. After receiving this notification, the Customer may, if they wish, place their order again at the correct price.
5.9. The price of the order is due upon completion of the order process as indicated in article 4.2.5.5.
5.10. Payment of the order price by the Customer takes place under the conditions set out in article 4.2.5.5.
5.11. Installment payment with ONEY

ARTICLE 6 – DELIVERY
6.1. Delivery methods:
6.1.1. Delivery of the ordered products takes place under the conditions chosen and validated by the Customer during the ordering process as stated in article 4.2.5.4.
6.1.2. Depending on the destination, delivery is offered during the ordering process through the services of the following providers:
- DPD Predict / DPD Europe
- UPS
- Private carrier, more specifically for deliveries of carpets and oversized products.
6.2. Delivery costs:
6.2.1. Delivery costs are borne by the Customer and are charged in addition to the selling price of the products.
6.2.2. Delivery costs are communicated to the Customer on the order summary, and in any case before the Customer validates their order at the end of the ordering process, and are expressed inclusive of all taxes.
6.2.3. Customs and other charges in the country of arrival are the responsibility of the recipient.
6.3. Delivery times:
6.3.1. The delivery times indicated below are those generally observed for the shipping services that may be offered during the ordering process, depending on the different service providers:
- DPD Predict: 6 to 7 days maximum.
- UPS, DPD Europe and other private carriers: 15 days maximum.
6.3.2. Delivery times are calculated from the date of dispatch of the order (subject to receipt of payment of the order price), concern only working days and do not include Saturdays, Sundays and public holidays.
6.3.3. For information purposes, it is specified that parcels are generally shipped within 48 hours after receipt and successful processing by CASA PEDRO of the Client's payment.
6.3.4. By default, and before the Customer proceeds to the stage where they select their preferred delivery method and timeframe as described in section 4.2.5.4, the order summary described in section 4.2.5.1 defaults to a shipping rate corresponding to a standard shipping method offered by the DPD service provider. The Customer can always modify their chosen delivery method and shipping options, as described in section 4.2.5.4, before confirming their order.
6.3.5. The package relating to the order is shipped to the Customer subject to the responsibility of the transport and delivery service provider; special care is taken with packages containing fragile products.
6.3.6. CASA PEDRO cannot be held responsible for the consequences due to a delay in delivery by the Carrier resulting from an unforeseeable and irresistible event.
6.3.7. Each shipment of parcels is accompanied by the invoice corresponding to the Customer's order.
6.4. Delivery receipt:
6.4.1. The Customer is required to verify the conformity of the Products received in execution of their order at the time of delivery. Any anomaly concerning the delivery, such as:
- damaged package,
- missing products,
- damaged products,
- products not conforming to the order,
Any claim must be notified within 48 hours of receiving the order to the website's Customer Service department via email at contact@casalopez.com. After this 48-hour period, in the absence of confirmation by Registered Letter with Acknowledgment of Receipt and except in the case of a hidden defect, no claim will be accepted by CASA PEDRO, and the Products sent by CASA PEDRO to the Customer will then be considered compliant.
6.4.2. In any case, damaged or incomplete items will not be taken back by CASA PEDRO and will be returned to the Customer in the condition in the event that they are reshipped, at the Customer's expense, to CASA PEDRO by the Customer.
6.4.3. Parcels returned to CASA PEDRO or to the carrier chosen by the Customer during the ordering process, due to incorrect recipient identification or incorrect identification of the order in question, may be returned to the Customer, provided that
- that the Customer communicates with CASA PEDRO,
- that the package proves to be identifiable
- that the package is actually returned to CASA PEDRO or remains in the hands of the said carrier.
- that the Customer bears the cost of this second shipment of the package.
6.4.4. Subject to the conditions stated above, CASA PEDRO will refund the total price of the Product(s), including VAT, excluding delivery charges stipulated in the order and any return shipping costs incurred by the Customer. The Customer's bank account, as provided by them during the ordering process as described in Article 4.2.5.5, will be credited with this amount within thirty (30) days of CASA PEDRO's receipt of the Products.
6.4.5. The return costs for a product declared not conforming to the order will be borne by CASA PEDRO on condition of an express request for this purpose made by the Customer under the conditions of article 6.4.1 for a postage to be sent to him at the expense of CASA PEDRO.

ARTICLE 8 – GUARANTEES AND RESPONSIBILITIES OF CASA PEDRO
8.1. In all cases CASA PEDRO cannot be held responsible in the event of failure to complete the order and its non-registration, and, in particular, due to the Client not correctly filling out their order according to the conditions set out in these General Terms and Conditions of Sale and according to what is displayed on the Client's fixed or mobile computer terminal during the online ordering process.
8.2. In all cases CASA PEDRO cannot be held responsible for the non-delivery of a registered order due to the Client not correctly filling in the information relating to the delivery address or the identification of the recipient according to the conditions set out in these General Terms and Conditions of Sale and according to what is displayed on the Client's fixed or mobile computer terminal during the online ordering process.
8.3. In all cases of force majeure, and in particular due to unforeseen and irresistible carrier actions, CASA PEDRO shall not be held liable for the non-delivery of a registered order. More generally, CASA PEDRO shall not be held liable for the non-execution or improper execution of the order in cases of force majeure, actions of third parties, actions of the Customer or its partners, such as internet network unavailability, inability to access the website, external intrusion, computer viruses, or, in the case of online payment, refusal by the cardholder's bank to authorize the transaction.
8.4. CASA PEDRO strives to ensure that the photographs and descriptions of the products provide as accurate a representation as possible of the products offered for sale online on the website. However, the photographs are not contractually binding, and therefore, the Customer cannot make any claim in this regard, provided that any differences between the photograph on the sales website and the actual product do not concern essential characteristics of the product that are, moreover, falsely or inaccurately represented on the website.
8.5. CASA PEDRO shall not be liable for any indirect and/or intangible damages, including but not limited to, loss of profit, loss of business, or moral damages resulting from a failure to deliver in full or in part or to conform in full or in part to the products ordered.
8.6. Hyperlinks on the website may lead to websites other than the website www.casalopez.com used for ordering CASA PEDRO products online, whether it is a site dedicated to the services offered by CASA PEDRO or to third-party or partner companies.
8.7. The provisions of Article 8 shall not prejudice the application of the provisions of Article 4.2.2.
8.8. In any event, CASA PEDRO cannot be considered the Producer of the products offered for sale on the website within the meaning of Articles 1386-1 et seq. of the French Civil Code, as the Producer is solely and exclusively liable for damage caused by a defect in its product, whether or not it is bound by a contract with the injured party. If an ordered and delivered product proves to be defective, the Customer must notify CASA PEDRO of this fact by registered letter with acknowledgment of receipt, using the contact details provided in the preliminary article, so that CASA PEDRO can designate its own supplier or the producer, within three months of the date on which the injured party's claim was notified.
ARTICLE 9 – DATA PROCESSING, FREEDOM AND PRIVACY, PERSONAL DATA, RIGHT TO ONE'S IMAGE
9.1. The Customer is informed that all personal data collected during the ordering process and in particular with regard to the creation of his customer account as stated in article 4.2.5.2 will be subject to automated processing, the controller of which is CASA PEDRO, whose full contact details are given in the preliminary article of these General Terms and Conditions of Sale .
9.2. The information containing personal data which is requested from the Customer during the ordering process on the website, is intended to be communicated by the Customer, and is necessary for the processing of his order by CASA PEDRO.
9.3. The recipients of the personal data collected during the ordering process are:
- CASA PEDRO;
- The online payment provider to the extent necessary for the implementation of articles 4.2.5.5, 5.10 of these General Terms and Conditions of Sale.
9.4. The purpose of processing this personal data is to fulfill the following objectives, in particular to enable CASA PEDRO to:
• proceed with order processing;
• proceed to register the order;
• fulfill its obligations towards the Client,
• Add the Client to the “Client File”.
9.5. In accordance with the provisions of French Law No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, each Customer has the right to access, modify, and rectify information concerning them, under the conditions provided by law and applicable regulations, by contacting CASA PEDRO at the contact details indicated in the preliminary article of these General Terms and Conditions of Sale. The Customer also has the right, for legitimate reasons, to object to the processing of their personal data.
9.6. On each personal data collection form, and particularly on those displayed during the ordering process or when creating their customer account, the Customer is informed whether the fields to be completed are mandatory or optional, indicated by the presence or absence of an asterisk. If one or more pieces of data indicated as mandatory during the online ordering process are not provided, the Customer's order cannot be completed or processed in any way.
9.7. In particular, during online payments involving the communication of the Customer's bank details for payment purposes, as stated in Article 4.2.5.5, these bank details will not be in the possession of CASA PEDRO, but must nevertheless be provided by the Customer for the performance of the sales contract, given their obligation to pay the price. The Customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection as defined by Law No. 78-17 of January 6, 1978 (Art. 69-6°). In any event, the Customer consents to this transfer for the performance of the sales contract resulting from the registration of their order with CASA PEDRO.
9.8. The Website does not generate cookies specifically for orders placed by the Customer for products offered for sale on the website. However, the browser used by the Customer to access and complete the online ordering process may generate cookies that will, in particular:
• to facilitate customer recognition based, where applicable, on the terminal from which the order is placed,
• to allow tracking of the progress of its ordering process, in particular to allow it to go back during this process,
• to allow the collection of statistical and technical data on the path and progress of the order process followed by the Customer which may be communicated to CASA PEDRO identified at the beginning of this document, without any personal data of the Customer being attached to it, for the purpose of modifying and technically and ergonomically improving the online ordering process and the corresponding interface.
In all cases, it is up to the Client using a terminal from which they place their online order to determine to what extent they wish to neutralize or allow cookies generated by their browser used during the online ordering process, without CASA PEDRO being held liable in this respect.
ARTICLE 10 – MISCELLANEOUS
10.1. These General Terms and Conditions of Sale are governed by French law.
10.2. In the event that any provision of these General Terms and Conditions of Sale is declared null and void, in any way and for any reason whatsoever, it shall be deemed unwritten and shall not invalidate the other provisions.
10.3. All disputes that may arise between the parties in connection with the interpretation and/or execution of these General Terms and Conditions of Sale shall, in the absence of an amicable agreement, be submitted to the exclusive jurisdiction of the competent court within the jurisdiction of the Court of Appeal of Paris, with the exception of disputes concerning non-commercial persons for which the legal rules of subject-matter jurisdiction apply.
